The Zoning Committee

The Zoning Committee has developed an outline for new zoning districts, a schedule of permitted and special uses, and is now working on minimal lot sizes for the proposed districts.

At an early meeting of the Committee, it was decided that observers would not be allowed to speak at the committee meetings and that in lieu of such participation, periodic reports would be released for review by the Boards and the public. After over 6 months of work, the Committee has released only one document for review by the Town and Plannng Boards and the public, their proposed revision of the purpose statement and an outline of proposed districts.

To speed up the process, the Committee now meets every two weeks.The next scheduled meeting is Tuesday, Feb. 3 at 7:00. The public is welcome to attend. Check the town website or call theTown Clerk for meeting schedules.

Currently there is debate within the Committee as to what zoning restrictions the town may place on properties and buildings within the official Ag District.  For some clarification on this matter you may review "Local Laws and Ag Districts, How Do They Relate", our newly uploaded brochure explaining the Ag Districts. and a document shared  with the Committee by member Tara Farnan on the limits of zoning restrictions on farm markets and temporary greenhouses

This Committee assigned to the task of updating our zoning code will generally meet every third Tuesday, at the Town Hall, at 7:30 pm beginning on July 1st. The public is invited to observe, but will not be allowed to comment during the meeting. 

The members of this committee are as follows: Carolyn Merritt, Tara Farnan (Planning Board), Phil Cook (Ag Committee), David Wilcox, Tom Murrin (ZBA), Bob Flickinger (Alt.) and Mark Kendall (Alt.) . Gary Boardman, Code Enforcement Officer, is a consultant to the committee and liaison between the committee and the Town Board. A committee chairperson has yet to be chosen.

At the committee meeting of July 1, Tom Murrin was appointed Chairman. The Committee will begin a section-by-section review and revision of the Barrington Zoning Code. Work was begun on the Definitions section. Mr. Wilcox volunteered to draft a Purpose Statement. Apparently the committee has decided not to utilize the services of the Genessee Finger Lakes Regional Planniing Council at this time, as was contracted for by the Town Board.

At the meeting of July 23, Mr. Wilcox' (who was unable to attend) draft of a purpose statement was reviewed and revisions were discussed.The Chairman handed out a summary of purpose statements from other town's Zoning Codes which included the purpose of zoning in the NYS Town Law. Mr. Fleckinger was given the task of submitting a revised draft. Considerable time was spent on Mr. Cook's draft revision of the "Applicabiity" paragraph.

The next meeting is scheduled for Monday, August 11 at 7:30. The committee will begin consideration of Zoning Districts and a re-draw of the district map. Mr. Murrin suggested that all members review the Comprehensive Plan in preparation for this meeting. Mrs. Farnan will provide copies of the Plan to fellow members, either on disc or hard copy. The Chairman also handed out information on the 14A Corridor Study's recommendatoins regarding deficiencies in the Barrington Zoning Code and the article by James Coon on how to evaluate a zoning code. When asked by Mr. Fleckinger his opinion about the inadequacies of the current districts and map, Mr. Boardman mentioned that the existing map gives insufficient attention to topographical features of the town (like steep slopes). The need for a commercial zone was also mentioned. Committee members were pointed towards chapter 6 of the Comprehensive Plan ("Future Land Use") as particularly relevant for their preparation for the next phase of their work. In the audience participation at the end of the meeting Mr. Knapp suggested that they review the Gorham Zoning Code and its District map, which breaks down districts by parcel.
